Terms of Service

We may revise these Terms; changes are effective when posted, and continued use means acceptance. We may modify or discontinue the Services at any time.

Firmtree provides business tools, educational content, an AI Startup Companion, and a provider/partner network. Content and AI outputs are informational only and are not legal, financial, tax, or investment advice; verify before relying on them.

Provide accurate information and keep credentials secure; you are responsible for all activity under your account.

Paid plans (Startup Companion $49/mo; Network Partner $199 to join then $199/mo) are billed via Stripe and renew until cancelled. Fees are non-refundable except as required by law; taxes are your responsibility.

Firmtree may facilitate introductions to independent third-party providers and shares lead information as described in the Privacy Policy. Firmtree does not provide their services and is not responsible for their acts, advice, or outcomes.

Use the Services lawfully. Do not exploit or harm others, harass, defame, spam, interfere with others’ use, upload malicious code, probe or test security, circumvent controls, scrape, reverse-engineer, or misuse AI features.

The Services, brand, and content are owned by Firmtree or its licensors. You receive a limited, revocable, non-transferable license to use the Services as intended; you may print/download a reasonable number of pages for your own use, and may not modify, republish, or remove proprietary notices.

You retain your content and grant Firmtree a license to host and process it to provide the Services. AI outputs may be inaccurate. Your inputs to AI features are not used to train third-party AI models.

Any feedback you send is non-confidential and may be used by us for any purpose without compensation.

The Services may link to or integrate third parties governed by their own terms; we are not responsible for them.

If you opt in, we may send recurring account, transactional, and (with consent) marketing texts via Resend. Message/data rates may apply. Reply STOP to opt out or HELP for help. Consent to texts is not a condition of purchase.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

To the fullest extent permitted by law, Firmtree is not liable for indirect, incidental, special, or consequential damages, and total liability for all claims will not exceed the amounts you paid Firmtree in the prior 12 months, up to $25,000.

You will indemnify and hold harmless Firmtree and its affiliates from claims and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, your breach of these Terms, or violation of law or third-party rights.

Disputes are resolved by final and binding individual arbitration; you and Firmtree waive jury trials and class or representative actions. Any permitted court proceeding is brought, as a last resort, in the state or federal courts located in Douglas County, Colorado.

These Terms are governed by the laws of the State of Colorado, except as preempted by U.S. federal law.

To report infringement, send our copyright agent a written notice identifying the work and infringing material with a good-faith and accuracy statement and your signature: [email protected], Attn: Copyright Agent, Firmtree Inc.

We may suspend or terminate access for any violation or to protect the Services.

If any provision is unenforceable it is severed and the rest remains in effect. These Terms with the Privacy Policy are the entire agreement; no waiver by non-enforcement; you may not assign without our consent.

The Business Assessment is a complimentary 30-minute consultation, subject to availability and scheduled through Firmtree’s calendar (hosted on Google Meet). Please give at least 24 hours’ notice to cancel or reschedule; repeated no-shows may result in losing access to booking. We may reschedule, decline, or end a session at our discretion. The assessment is informational only — it does not create a client, advisory, fiduciary, or professional-services relationship, and no specific result or outcome is promised. Recommendations may include Firmtree’s paid services and referrals to Network Partners; Network Partners pay Firmtree to participate in the network, so a referral may be compensated.

Answering by voice during intake is optional. If you do, we transcribe your answer and delete the audio, keeping only the transcript (see the Privacy Policy). We do not record the assessment meeting itself unless we tell you in advance and obtain consent. If you share a website or upload documents, you represent that you have the right to share them and that you will not submit third-party confidential information, protected health information, payment-card numbers, government identification numbers, or other sensitive personal information — and nothing you would not want processed by our AI service providers. If you add guests, you represent that you have their permission to share their name, title, and email to send the invitation; guests receive the calendar invite only and are not added to marketing unless they opt in themselves.
